Wage & Hour Rights and Responsibilities

Wage Payment: Employee rights include:- Spend for all wages made (INFO # 3) at the rate agreed to by the employer and worker.

– Pay of at least base pay (INFO # 1), the relevant Colorado or local minimum wage, and all made overtime salaries without impermissible reductions from their earnings;.

– Pay of all made wages without impermissible reductions (INFO # 16).

Labor Statutes, Rules, & Published Guidance

Statutes & Rules: DLSS imposes a lot of Colorado’s wage and hour and other types of labor statutes and labor guidelines, including the Colorado Wage Act, the Colorado Overtime and Minimum Pay Standards ( » COMPS Order »), and the Equal Spend For Equal Work Act. Please go to the Division’s Labor Statutes and Labor Rules websites for present and prior variations of key Colorado labor statutes and rules.

Published Guidance: The Division’s main kinds of public guidance are:- INFOs (Interpretive Notices and Formal Opinions) – the Division’s officially authorized notifications, opinions, and explanations on different labor law topics; and.

– KNOWLEDGEs (Knowledge for Workers on Labor Law is Empowering & Drives Good Employment) one-page summaries for workers on their labor rights.

Written Demands, Complaints, & Investigations

Demands & Complaints for Wages: If an employer owes you wages, you can send your company a composed demand for payment of salaries by mail, e-mail, text, or other electronic means. A written need might be sent out to the employer at the same time a Labor Standards Form for referall.us unpaid wages is submitted with the Division. The Labor Standards Complaint Form can be found on our Demands, Complaints, Responses, and Settlements website.

Employer Responses in Investigations: Once a total Labor Standards Complaint Form is gotten and evaluated, a letter describing the nature of the complaint and the amounts declared to be owed is sent out to the company. For more details about the investigation procedure, please examine the Wage & Hour Claim Investigations – Employer FAQs website.

Investigations Launched by the Division ( » Direct Investigations »): The Division may perform employer-wide direct investigations of possible violations of Colorado wage and hour law. If you want to submit a pointer, please email the Division at cdle_di_tips@state.co.us. If you wish to submit a private claim for overdue earnings, you should submit a Labor Standards Complaint Form on our Demands, Complaints, Responses, and Settlements web page. To appeal a direct investigation citation or one or more Notices of Assessment, an alleged employer may submit a Direct Investigation Appeal Form.
